Terms of Service

1. Acceptance of Terms
By accessing or using services provided by Thamra Group for Technology and Trading LLC ("Thamra Group," "we," "us," or "our"), a company registered in the State of Qatar, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization. If you do not agree to these Terms, please do not use our services.
2. Description of Services
Thamra Group provides AI-powered business solutions delivered on a software-as-a-service (SaaS) basis. Our portfolio includes multiple AI agents, each governed by its own service-specific terms. Current agents include:
- CARE (Customer AI Response Engine) — AI-powered customer support for Arabic-speaking businesses.
- CORE (Business Command Center) — Business management dashboard.
Additional agents may be introduced over time. Each agent's billing, pricing, cancellation, and refund terms are detailed in their respective service terms.
3. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for ensuring that all users within your organization comply with these Terms.
4. Acceptable Use
You agree not to use our services to:
- Violate any applicable law, regulation, or third-party rights.
- Transmit any harmful, threatening, abusive, defamatory, or otherwise objectionable content.
- Distribute malware, viruses, or any code designed to disrupt or damage systems.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the AI services to generate misleading, fraudulent, or deceptive content intended to harm others.
- Impersonate any person or entity through the AI-generated responses.
- Use the services in a manner that could overload, disable, or impair our infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the service.
Thamra Group reserves the right to suspend or terminate accounts that violate this acceptable use policy without prior notice.
5. Agent-Specific Service Terms
Each AI agent offered by Thamra Group has its own service-specific terms covering billing, pricing, refunds, cancellation, and add-ons. By using a specific agent, you also agree to that agent's service terms:
- CARE Service Terms — Billing, pricing, and cancellation for the CARE AI agent.
- CARE Refund & Billing Policy — Refund and payment terms for CARE services.
In the event of a conflict between these general Terms and any agent-specific service terms, the agent-specific terms shall prevail with respect to that agent's services.
6. Intellectual Property
All intellectual property rights in the Thamra Group platform, including but not limited to software, algorithms, models, designs, trademarks, logos, and documentation, are and shall remain the exclusive property of Thamra Group for Technology and Trading LLC.
You retain full ownership of your data, including customer data, conversation content, and any data you upload to or generate through the platform. Thamra Group claims no ownership over your data.
You grant Thamra Group a limited, non-exclusive license to process your data solely for the purpose of providing and improving the services. This license terminates upon account closure and deletion of your data.
7. AI-Generated Content Disclaimer
CARE and other Thamra Group AI agents generate responses using artificial intelligence technology. While we strive for accuracy and quality, AI-generated responses:
- May not always be accurate, complete, or up to date.
- Should not be relied upon as professional, legal, medical, or financial advice.
- May occasionally produce unexpected or incorrect outputs.
- Are generated based on training data and configured knowledge bases, which may have limitations.
You are solely responsible for reviewing and verifying AI-generated content before it reaches your end customers. Thamra Group is not liable for any decisions made or actions taken based on AI-generated responses.
8. Warranty Disclaimer
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THAMRA GROUP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THAMRA GROUP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR DATA WILL NOT BE LOST OR DAMAGED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THAMRA GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
IN NO EVENT SHALL THAMRA GROUP'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE TOTAL FEES PAID BY YOU TO THAMRA GROUP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE THOUSAND (1,000) QAR, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless Thamra Group, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or data you submit through the services.
11. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, war, terrorism, riots, government actions, internet or telecommunications failures, power outages, pandemics, or cyberattacks. The affected party shall notify the other party promptly and make reasonable efforts to mitigate the impact.
12. Service Modifications
Thamra Group reserves the right to modify, suspend, or discontinue any part of the services at any time. For material changes that negatively affect your use of the services, we will provide at least thirty (30) days' prior notice. If you do not agree with the changes, you may cancel your subscription before the changes take effect.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Qatar, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the competent courts in Doha, Qatar.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy and any applicable agent-specific service terms (such as the CARE Service Terms and CARE Refund Policy), constitute the entire agreement between you and Thamra Group regarding the use of our services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
